These Terms & Conditions govern your use of services provided by Ombracol Communications LLC (“Ombracol,” “we,” “us,” or “our”) and any communications — including phone calls and text messages — sent through our platform on behalf of a dealership client. By engaging with these services, you agree to these Terms.

2. Description of Service

Ombracol provides outsourced business development center services to automotive dealerships, including inbound and outbound calling, text messaging, and service appointment scheduling, delivered on the dealership’s behalf to its own customers.

3. SMS Messaging Program Terms

• Consent. You may receive text messages from a dealership through Ombracol’s platform because you provided your mobile number and agreed to be contacted — for example, during a service visit, vehicle purchase, or appointment scheduling call with the dealership.
• Message frequency. Message frequency varies based on your interactions with the dealership.
• Message and data rates may apply. Standard rates from your wireless carrier may apply.
• Opt-out and help. Reply STOP at any time to stop receiving messages, or HELP for assistance.
• Carrier liability. Carriers are not liable for delayed or undelivered messages.

4. Use of Our Services

You agree not to use Ombracol’s services for any unlawful purpose, or in any way that could damage, disable, or impair our platform or interfere with any other party’s use of it.

5. Intellectual Property

All content, trademarks, and materials associated with Ombracol and its platform are the property of Ombracol Communications LLC or its licensors and may not be used without prior written permission.

6. Disclaimers & Limitation of Liability

Our services are provided “as is” without warranties of any kind, express or implied. To the fullest extent permitted by law, Ombracol Communications LLC will not be liable for any indirect, incidental, or consequential damages arising from your use of, or inability to use, our services.

7. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law principles.

8. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated “Last updated” date. Continued use of our services after changes are posted constitutes acceptance of the revised Terms.
